Strict Code of Practice

NAADA strives to uphold a Strict Code of Practice which all of its members adhere to. In the event of a dispute NAADA is willing to intervene and help mediate an equitable solution. The Code of Practice has been introduced to give members of the public confidence when they make a purchase from a member.

Members are required to:

  1. Label all items with correct dating and clear pricing.
  2. Members should display the NAADA logo in their windows and on their business cards.
  3. Provide a written invoice stating condition and details of item purchased. The invoice should display the members’ vat number, address and telephone numbers.

GENERAL
1. This Code binds all Members in their dealings with Customers and are compliant to the SA Consumer laws.

PRICES
2.1 All goods for sale shall have the full VAT-inclusive price  on a label  attached to or next to the article. Where the item is price on request an inventory of price lists must be made readily available to all interested parties.

DESCRIPTIONS AND ATTRIBUTIONS
3. The Member shall include an invoice and sales tag which details the date and/or period of the item, the maker’s name and/or artist as well as the major material used ie. what wood, bronze, spelter, oil on board or oil on canvas. All major restorations must be disclosed or any later additions to the piece.

4. Upon sale of the item a professional invoice is to be used with the members’ vat number, address and phone number as well as the NAADA logo on it. The description of the item should be the same as on the sales ticket and any other information provided by the member may be included. An address of the purchaser should be included on the invoice  and where possible a copy of their ID document should be attached to the shop copy. Means of payment should also be included.

5. Sale of stolen goods is prohibited as per the consumer law and the Second Hand Dealers Act of South Africa.

DEPOSITS
6. If a Member accepts a deposit on an item the invoice should clearly state the deal the two parties have entered into and it should state when final payment will be made by the purchaser as well as the agreement entered into should payments not happen. ie when that item can be resold if the purchaser fails to make payments.

7) Reserving of items at an antique fair or a member’s shop – the member, when reserving items for a buyer should make it clear, in writing where possible, the length of time they are prepared to reserve the item.

HOME VISITS
8). Members are prohibited from making unsolicited visits to private domestic premises. Our members are professional and many of them do charge a call out fee. Members of the public may contact us to find out if the fees charged are very high or not. However the charging of fees is up to each members’ discretion.

AUTHORITY
9. Members have no authority to act on behalf of NAADA or speak for it unless specifically authorised by the Directors, nor does membership of NAADA imply any guarantee of authenticity.

VALUATIONS

10. Valuations  shall be provided in writing by our members. The valuations should mention if it is for replacement purposes or insurance and should be dated and forms should have a NAADA logo on them.

ATTENTION IS EXPRESSLY DRAWN TO THE FACT THAT NOTHING IN THE ABOVE CONDITIONS SHALL AFFECT THE LEGAL RIGHTS OR OBLIGATIONS OF ANY PARTY TO A DISPUTE
